I had a lot of posts on the green card issue two years ago on the Wenxuecity.com under Return China section. I haven't visited the site for a while, since I am in China now, I don't know if it is still there. But you can check it out. But looking at your case, I would suggest the following: 1. In general, since you are already 3 years in the US, you have already met the naturalization requirements. 2.I would wait for another six month, until you are qualified for the citizenship filing. YOu are alrady so close. No need to invite too much complications. YOu may already know you can file one year ahead of the 5 year period, right? After the filing, you are basically OK... as long as you are in the US, when interview is on. 3. On the interview, you probabaly need to tell the INS that you are on a temporary basis working in China. Don't give them the impression you are cheating on the green card. 4. If you insist to come to China now, I would recommend you still come every 6 month back to US. 5.It dose not matter, if you work for a China or US company in your case. The working for US company part is only usefull, if you want to apply for the continuity of your US residencey, which is another topic. The paradox I came across is the stupid IRS asked me to provide the document to indicate my company is a US company. It was a public company. So they ridicously asked me to prove that 51% of the stock owner holds the US passport! I was wondering which planet they are living!!!!!!!!!!!!!!! So, the bottom line is US company or not does not really work, althought the INS webpage makes it souund like important.
6. Last, but not least important is the chance to work in China. If you have a few years of experiences, there is a lot in most of the industries. Don't worry that you may miss this boat. There is a plenty of boat there. I am telling you from my own experiences as a previous jobhunter and current hiring manager. China is in its fastest growing period with world economy going upwards. There are jobs everywhere for higher level people. The concern, as matter of fact for me in last year, is how to find good people (see my previous job postings), not how to lay people off.
Hope that helps. Jlink
------------------------------------------------------------------------------ Hi All:
Just found this site and like it so much. Thanks a lot in advance if somebody could answer the following questions.
I have green card for 3.5 years and am planning to quit my current job and work for a private Chinese company for 2-3 years. My spouse (green card holder) and children (US citizens) will stay here in the US in the meantime. My plan is to come back every 3-4 months and stay for a few weeks, and keep filing taxes, paying bills and mortgage etc.
1. Will I have any risk of losing my green card? 2. Will there be any problems when I apply citizenship in 1.5 years? 3. Do I need or Can I apply reentry permit for my case (working for a Chinese company)?
Thanks again,
LaoGui
